These Terms of Service (“Terms”) govern your enrollment in, and use of the training, flight instruction, and other educational services (collectively, “Services”) provided by Southern Horizon Aviation Academy (hereafter “we”, “us”, “our”, or “Academy”). By registering for or using our Services, you (“Student”, “you”, “your”) agree to these Terms.
1. Description of Services
The Academy provides flight training, ground-school instruction, accelerated course options, and related services in general aviation and pilot certification.
Services may include but are not limited to private pilot, instrument, commercial, multi-engine training, and student access to training materials, simulators and aircraft.
2. Student Eligibility & Responsibilities
- You represent that you are legally eligible to participate in training (e.g., age, medical certificate requirements under Federal Aviation Administration (FAA) Part 61 as applicable).
- You will provide accurate and complete information when enrolling (including medical status, prior flight time, contact info).
- You agree to comply with all Academy policies (including attendance, proficiency standards, student conduct, safety rules, aircraft rental rules).
- You are responsible for obtaining and maintaining any required medical certificate, pilot certificate, insurance, and for understanding FAA regulations applicable to your training.
- The Academy reserves the right to withdraw you from training if you fail to meet proficiency, safety, or policy standards.
3. Fees, Payment & Refunds
- Your enrollment will require payment of tuition, deposit requirements (e.g., $500 non-refundable deposit as referenced in your materials) and any other charges as published by the Academy.
- Payment may be via autopay, credit card, bank transfer or other method the Academy accepts.
- Deposits may be non-refundable as specified in the membership or training agreement (e.g., if you cancel or fail to start the program).
- Refunds: Unless otherwise agreed in writing, tuition and fees once paid are non-refundable once training has commenced. If the Academy cancels a scheduled course before you start, you may receive a refund or credit toward a future course.
- Late payments or returned autopay may incur late fees or cause suspension of training access.
4. Scheduling, Cancellations & Rescheduling
- The Academy may cancel or reschedule services due to instructor availability, aircraft maintenance, weather, or other operational constraints; the Academy will make reasonable efforts to notify you and reschedule accordingly.
5. Safety, Conduct & Use of Equipment
- Safety is paramount. You agree to follow FAA regulations, Academy safety policies, pre-flight and post-flight procedures, instructor directions, and aircraft rental rules.
- You must use equipment (aircraft, simulators, training materials) only for authorized purposes and in compliance with applicable regulations and Academy policies.
- Reckless or unsafe conduct may result in suspension or termination of your training agreement.
6. Intellectual Property & Training Materials
- All training materials, checklists, slide decks, policy documents, membership forms and other content provided by the Academy remain the property of the Academy (or its licensors) and are protected by copyright and other intellectual property laws.
- You may use these materials only for your own personal training within the Academy. You may not reproduce, distribute, publish, post, or otherwise make available any materials for commercial use or external parties without the Academy’s express written permission.
7. Limitation of Liability & Disclaimer of Warranties
- The Academy provides training in accordance with FAA regulations and industry standards, but you acknowledge that aviation involves inherent risks.
- To the fullest extent permitted by law, the Academy disclaims all warranties, express or implied, including any implied warranty of fitness for a particular purpose or merchantability.
- In no event will the Academy, its owners, instructors, employees, agents, or affiliates be liable for any indirect, incidental, consequential, special or punitive damages (including lost profits, loss of use, personal injury, death, or property damage) arising out of or in any way connected with your use of the Services—even if advised of the possibility of such damages.
- Your enrollment and use of Services are at your own risk.
8. Termination & Suspension
- Either you or the Academy may terminate your enrollment/training agreement upon written notice, subject to the policies in the enrollment contract and refund terms above.
- The Academy may immediately suspend or terminate your training, membership or aircraft rental privileges if you breach these Terms, engage in unsafe conduct, fail to meet proficiency or medical requirements, fail to pay fees, or otherwise violate Academy policy.
- Upon termination or completion of training, you must return any Academy equipment or materials, settle any outstanding debts, and cease use of the Academy’s name, branding or materials.
9. Amendments
- The Academy reserves the right to modify or amend these Terms at any time. We will publish the revised Terms on our website and/or provide you notice. By continuing to use the Services after changes become effective, you agree to be bound by the revised Terms.
- You should review the Terms regularly for changes.
10. Governing Law & Dispute Resolution
- These Terms and the relationship between you and the Academy are governed by the laws of the State of Arkansas, without regard to its conflict of law principles.
- Any dispute arising out of or relating to these Terms or your training/membership must be resolved first by good-faith negotiations. If not resolved, the dispute may be submitted to binding arbitration in [County], Arkansas, under the rules of the [appropriate arbitration body], or alternatively by a court of competent jurisdiction in [County], Arkansas (depending on the enrollment agreement).
- You and the Academy consent to exclusive jurisdiction and venue in the state or federal courts located in Arkansas.
11. Severability & Waiver
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Failure by the Academy to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
