Terms and Conditions

These Terms of Conditions (“Terms”) govern your enrollment in, and use of the training, flight instruction, and other educational services (collectively, “Services”) provided by Southern Horizon Aviation Academy (hereafter “we”, “us”, “our”, or “Academy”). By registering for or using our Services, you (“Student”, “you”, “your”) agree to these Terms.


Southern Horizon Aviation Academy Terms and Conditions

By using this website, submitting a training request, scheduling training, purchasing training services, or participating in any training provided by Southern Horizon Aviation Academy, you agree to the following Terms & Conditions.

1. Training Services

Southern Horizon Aviation Academy provides flight training, ground instruction, aircraft transition training, insurance checkout training, flight reviews, instrument proficiency checks, customized training, and related aviation education services.

Training will be provided under 14 CFR Part 61. Southern Horizon Aviation Academy is not a Part 141 flight school.

Training completion times, course lengths, costs, and outcomes may vary based on student proficiency, weather, aircraft availability, maintenance, scheduling, FAA requirements, examiner availability, and other operational factors.

2. No Guarantee of Certification or Check ride Outcome

Southern Horizon Aviation Academy is committed to providing high-quality instruction; however, no guarantee is made that a student will complete training within a specific number of days, flight hours, lessons, or total cost.

No guarantee is made that a student will pass any FAA knowledge test, practical test, stage check, flight review, instrument proficiency check, insurance checkout, or other evaluation.

Student success depends on preparation, proficiency, aeronautical decision-making, attendance, study habits, aircraft availability, weather, and compliance with FAA requirements.

3. Student Responsibilities

Students are responsible for:

  • Meeting all applicable FAA eligibility requirements 
  • Maintaining required documents, including government-issued photo ID, pilot certificate, medical certificate, student pilot certificate, logbook, and endorsements 
  • Completing required ground study and preparation 
  • Arriving on time and prepared for scheduled training 
  • Following instructor guidance and safety procedures 
  • Complying with FAA regulations, airport rules, aircraft operating limitations, and Southern Horizon policies 
  • Paying all required fees, deposits, and balances when due 

Southern Horizon Aviation Academy reserves the right to discontinue or reschedule training if a student is unprepared, unsafe, noncompliant, medically unfit, or otherwise unable to safely participate.

4. Scheduling, Weather, and Aircraft Availability

Flight training is subject to weather, aircraft availability, maintenance, instructor availability, airport conditions, airspace restrictions, and other operational considerations.

Southern Horizon Aviation Academy may cancel, delay, modify, or reschedule training when safety, weather, maintenance, or operational conditions require it.

Students understand that accelerated training requires flexibility and that exact completion dates cannot be guaranteed.

5. Payment, Deposits, and Fees

Pricing, deposits, course fees, hourly rates, aircraft rental rates, instructor rates, lodging costs, and other charges are subject to change.

Any quoted price applies only to the specific course, aircraft, training package, and terms listed in the written quote or invoice.

Additional training beyond the included course hours, if applicable, will be billed at the current applicable hourly rate.

Students are responsible for all charges associated with training, including but not limited to aircraft rental, instruction, ground instruction, supplies, FAA testing fees, examiner fees, travel expenses, lodging, and additional training as applicable.

6. Refunds and Cancellations

Refund eligibility depends on the specific program, package, deposit agreement, and written terms provided at the time of enrollment.

Deposits may be non-refundable if used to reserve instructor time, aircraft availability, lodging, course materials, or training dates.

Any unused prepaid training funds may be reviewed on a case-by-case basis. Refunds, if approved, may be reduced by completed training, aircraft rental, instructor time, lodging costs, administrative fees, merchant processing fees, course materials, and other expenses already incurred.

Southern Horizon Aviation Academy reserves the right to cancel or discontinue training due to safety concerns, nonpayment, student misconduct, lack of preparedness, medical concerns, regulatory issues, or other reasonable cause.

7. Lodging and Accommodations

Some training packages may include or assist with lodging arrangements. Lodging availability, location, amenities, and terms may vary.

Students are responsible for treating lodging accommodations respectfully and may be financially responsible for damage, cleaning fees, incidentals, rule violations, or other charges assessed by lodging providers.

Southern Horizon Aviation Academy is not responsible for issues outside its control involving third-party lodging providers, hotels, property owners, or accommodation services.

8. Aircraft Rental and Third-Party Aircraft

Training may be conducted in aircraft owned, leased, rented, managed, or otherwise made available through Southern Horizon Aviation Academy, flying clubs, aircraft owners, or third-party providers.

Aircraft availability is not guaranteed and may be affected by maintenance, scheduling, weather, inspections, insurance requirements, or operational limitations.

When training in a student-owned or third-party aircraft, the student is responsible for ensuring the aircraft is airworthy, properly insured, legally operated, and equipped for the intended training.

Southern Horizon Aviation Academy and its instructors reserve the right to refuse training in any aircraft deemed unsafe, unairworthy, unsuitable, improperly equipped, or noncompliant with applicable requirements.

9. Safety and Operational Control

Safety is the top priority. Southern Horizon Aviation Academy and its instructors may stop, cancel, modify, or refuse any flight or training activity if safety may be compromised.

Final authority for any flight rests with the pilot in command as defined by FAA regulations.

Students must comply with all applicable FAA regulations, aircraft operating limitations, airport procedures, instructor instructions, and safety requirements.

10. Medical Fitness and Personal Readiness

Students are responsible for determining whether they are medically and physically fit to participate in flight training.

Students must notify Southern Horizon Aviation Academy of any condition, medication, fatigue, impairment, illness, or other factor that may affect safety or legal eligibility to fly.

Southern Horizon Aviation Academy may decline or discontinue training if there is a reasonable concern regarding safety, impairment, or medical fitness.

11. FAA Requirements and Third-Party Fees

FAA written test fees, practical test fees, examiner fees, aircraft rental for check rides, retesting fees, FAA application fees, and other third-party charges are typically not included unless specifically stated in writing.

Designated Pilot Examiners, FAA testing centers, medical examiners, lodging providers, maintenance providers, and other third parties operate independently from Southern Horizon Aviation Academy.

Southern Horizon Aviation Academy is not responsible for third-party scheduling delays, price changes, cancellations, or decisions.

12. Website Information

Information on this website is provided for general informational purposes only. While Southern Horizon Aviation Academy attempts to keep information accurate and current, website content may contain errors, omissions, outdated information, or typographical mistakes.

Southern Horizon Aviation Academy may update, modify, or remove website content, pricing, programs, policies, and availability at any time without prior notice.

Website information does not create a binding contract unless confirmed in a written agreement, invoice, or enrollment document.

13. Intellectual Property

All website content, logos, branding, text, graphics, training materials, course materials, documents, forms, syllabi, guides, and other materials created by Southern Horizon Aviation Academy are the property of Southern Horizon Aviation Academy unless otherwise stated.

These materials may not be copied, reproduced, distributed, modified, sold, or used for commercial purposes without written permission.

14. Photos, Videos, and Marketing

Southern Horizon Aviation Academy may take photos, videos, or other media during training, events, or academy-related activities for educational, promotional, or marketing purposes.

Students may request not to be included in marketing media by notifying Southern Horizon Aviation Academy in writing.

Southern Horizon Aviation Academy will make reasonable efforts to honor such requests.

15. Communications

By submitting a form, requesting information, scheduling training, or enrolling in a program, you authorize Southern Horizon Aviation Academy to contact you by phone, text message, email, or other reasonable communication methods regarding training, scheduling, billing, and academy-related information.

Message and data rates may apply.

16. Limitation of Liability

Aviation activities involve inherent risks. By participating in training, students acknowledge that flight training and aircraft operations carry risks including, but not limited to, personal injury, property damage, financial loss, delay, and other hazards associated with aviation.

To the fullest extent permitted by law, Southern Horizon Aviation Academy, its owners, instructors, employees, contractors, representatives, and affiliates shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from website use, training participation, scheduling delays, cancellations, third-party services, or aviation activities.

Nothing in these Terms is intended to waive rights or obligations that cannot legally be waived under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Southern Horizon Aviation Academy, its owners, instructors, employees, contractors, representatives, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your violation of these Terms, failure to comply with laws or regulations, unsafe conduct, damage to property, or participation in training activities, except where prohibited by law.

18. Right to Refuse Service

Southern Horizon Aviation Academy reserves the right to refuse, cancel, suspend, or discontinue services for any reason permitted by law, including but not limited to safety concerns, nonpayment, inappropriate conduct, regulatory noncompliance, lack of preparedness, aircraft concerns, or operational limitations.

19. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Any disputes shall be handled in the appropriate courts located in Arkansas unless otherwise required by law.

20. Changes to These Terms

Southern Horizon Aviation Academy may update these Terms & Conditions at any time. Updates will be posted on this website with a revised effective date.

Continued use of the website or participation in training after changes are posted constitutes acceptance of the updated Terms.
